Terms of use for images
The BAW has acquired all rights of use from the authors of the digital images unless otherwise stated, e.g. in the information accompanying the images.
The information accompanying the images and any restrictions regarding their use and exploitation must be observed. The user will be held liable for any damages resulting from a failure to comply with this rule. The user must release the BAW from any claims asserted by third parties in this respect. Special terms of use apply to the use of images from the historical image library of German federal waterways.
The images can be downloaded free of charge as a basic principle and can be used for reporting for the following purposes: press releases, publications on film or television
Any other use for commercial purposes, particularly for advertising purposes, is not permitted.
Any editing, modifying or manipulating of digital images that goes beyond the scope of colour corrections, cuttings and reductions in size is inadmissible and will only be permitted with the BAW’s prior written consent. Digital images may not be reproduced in any context that distorts their original meaning.
Any distortion of copyrighted works in image, text or any other form, e.g. by photographic reproduction, adulteration by drawing, photomontage or electronic means is inadmissible. The user is responsible for the accompanying text.
The press is obliged to observe the journalistic principles of the German Press Council (Press Code) in particular. Consent given for the use of charts and images does not imply that the persons appearing in the images, the holders of rights to items appearing in the images or the holders of trademark or any other property rights have given their consent to public reproduction. The user is obliged to seek the consent of third parties wherever required in individual cases. The user must observe the moral rights, copyright, trademark rights and any other property rights of persons, works, objects or symbols appearing in the images. If any of the above rights are violated, the user will be solely liable for damages payable to any third parties.
The BAW reserves the right to carry out investigations if there are grounds to suspect improper use or a material infringement of the terms and conditions of use.
Whenever a digital image is used, the source ‘first name and surname of the photographer / BAW’ must be indicated. This also applies to electronic publications, e.g. websites. Prior to any publication in print, a file copy must be submitted to the BAW unprompted and free of charge.
